Officers from the Scarsdale Police Department were dispatched to Walworth Avenue shortly after 11 p.m. on Friday, Feb. 1, where there was a report of the crash. Upon arrival officers found a BMW parked in the middle of the road with an airbag deployed.
Police said that it was determined the driver - Matthews, N.C. resident Derrick Lamont Ephraim - was driving south on Walworth Avenue when a car coming in the opposite direction drifted into his lane. In an effort to avoid the car, Ephraim allegedly swerved and struck a parked Lexus in the rear wheel.
While interviewing Ephraim, the officers said they smelled alcohol on his breath, prompting further investigation. Ephraim admitted that he had “two small bottles of merlot wine” prior to the incident and proceeded to fail multiple Standardized Field Sobriety Tests, during which he stopped when his cell phone rang. Ephraim consented to take a breathalyzer, but could not comply with the instructions on how to complete the test.
Ephraim, 30, was arrested and transported to Scarsdale Police Headquarters. After being booked, police said that officers attempted to check his blood alcohol content and Ephraim was very uncooperative. Ephraim then refused to take the test three times, leading to additional charges. He was charged with driving while intoxicated, a misdemeanor, as well as refusal to take a breath test and operating a motor vehicle without a license, both infractions. Ephraim was released to his mother and is due back in court at a later date.
